EXPLANATION OF THIS DOCUMENT
This
document assigns the copyright in and to an item that has been created
by a party (i.e. a web page developer or programmer) to the customer.
This document takes away any right of the author to use the work
following the assignment. Caution should be taken if the work has previously
been integrated into another work by the author as that work may infringe
upon the rights being conveyed in this document.
Normally
it is not in the interest of the author to convey the entire copyright.
Generally, the developer will retain the copyright and license
the use of the content to the customer subject to the terms and conditions
of the license. However, some clients will insist that they
be assigned the copyright to the work.
Oftentimes the copyright will be conveyed under a “work for hire”
provision in the development contract.
However, the work for hire provision will generally not be effective
to convey rights to materials that were previously developed and which
were not specifically developed in connection with the current development
project. This form can be used to convey the copyrights
to previously developed materials that would not be included within
a work for hire provision. This
form can also be used to transfer the copyright to the entire work in
the absence of a work for hire clause.
